Overview
- Carry out contracts management tasks for Lafarge Ready Mix. Responsible for the creation, management and control phases of all contracts related to commercial business for Lafarge Ready Mix. Handle correspondences, claims, counter-claims, negotiations, techno-contractual, contract commercial issues.
- Coordinate with commercial, quality, operations, finance, accounting, procurement and legal teams.
- Assist and Educate head office management and plants management on contractual liabilities and contractual entitlements.
- Contribute to a more positive operational EBITDA through good practices of contracts management, management of pricing, escalations, etc.
- Management of contractual risks by close coordination between departments and by cascading/ transferring risks to suppliers/ subcontractors.
- Execution and monitoring of price escalations (CAPMAS escalations and/or raw material escalation).
Responsibilities:
1-Health & Safety:
- Adhere to and enforce relevant legislation and policies and ensure that the highest degree of safety and safe working practices are maintained.
2-Functional:
- Facilitate communication between organization’s stakeholders. Coordination with all concerned parties for each new contract (Commercial, Operations, QC, finance and purchasing). Provide feedback regarding the compliance of H&S and operations with contractual requirements in line with company policies.
- Develop and deliver techniques and practices for Contracts formation and administration in a manner that safeguards the company's interests. Amend contracts terms and conditions received from clients to limit LH's liabilities and secure the entitlements. Aim on less risk exposure.
- Interpretation of contract terms and conditions, and conduct contract troubleshooting esp. in case of ambiguous or contradicting terms.
- Define Contracts recommendations that support business goals in collaboration with management. Ensure that commercial strategies are contractually implemented in line with business objectives
- Support, Manage, Develop and Administer all contracts related documents. Draft and review contract terms and conditions as well as contract appendices along with all other documents such as Official Correspondences, Purchase Orders, etc. with due regards and consideration to the ruling laws (Bidding laws, civil law, FIDIC, etc)
- Monitor and ensure enforceability/ applicability of Contract Controls: Bonds, Insurances, Retention, Warranties, Liquidated and Ascertained Damages, etc.
- Conduct site visits to projects with clients to resolve techno-contractual issues and finalize pending commercial matters.
- Review and amend instructions from clients that deviate from contract terms and assess the potential time and or cost impact and communicate to management and to clients. Ensure compensation for such deviations.
- Negotiate change in scopes of contracts with clients and derive pricing of new mixes based on existing contract conditions and communicate changes to all relevant stakeholders.
- Resolution of issues from the earliest phase to mitigate conflicts/ disputes. Resolve major claims and negotiate/ draft claim defense/ resolve disputes with clients. Highlight the proposed company Claims and associated costs and extension of time and prepare the claim documents. Following up on claims until resolution with all stakeholders. Monitor Contract Correspondences and provide appropriate input to protect organizations against potential claims.
- Coordinate with treasury issues related to guarantees, extensions, wording of bonds, etc. (performance guarantees and advance payment guarantees)
- Coordinate with purchasing/ procurement to educate them on contractual obligations and collaboratively work on cascading liabilities and obligations to our suppliers, especially for long term commitment projects to bridge the gap between our liabilities and the suppliers' performance, for less risk exposure.
- Evaluate potential risks, suggest measures to mitigate such risks. Analyze and prepare a risk assessment for new projects.
- Handle the Variation Requests and preparing the required letters, breakdowns, formalities and meetings up to the Variation Order finalization
- Administering follow up of payments and application of penalties/ compensations. Monitor credit management
- Management of price escalations, communication to finance and accounting depts. Communicate and obtain data from governmental agencies (CAPMAS) and track actual change in price of raw materials from suppliers to ensure that all escalations guarantee a compensation that exceeds the actual increase of raw materials.
- Standard project management plan for plants demobilization & mobilization from the contracts management side: detailed analysis of contractual requirements and liabilities and set a proper control mechanism to ensure compliance with LH commitments, other commercial terms and conditions, implementation of standard LH contract for major projects, transfer to Procurement back to back liabilities, etc.
- Extract lessons learned from substantially completed contracts for avoidance of pitfalls in new contracts and to maximize profitability through formulating better escalation formulas, etc.
Qualifications
Education and Work Experience:
Education:
- Bachelor Degree of Civil/ Construction Management/ Structural
- Contracts & Legal Aspects in Construction Diploma is a plus.
Technical Skills:
- Contracts Administration, FIDIC.
Experience:
- 5 – 7 years of experience in a similar job.
